If the decision casts further uncertainty around CFPB’s existing regulation, that’s probably bad for business. To that point, the CFPB issued new guidance to credit-reporting agencies Thursday about omitting what it called "junk data" from credit reports. As set up under the 2010 Dodd-Frank Act, the CFPB is funded by the Federal Reserve rather than congressional appropriations. That way, in the Obama administration’s view, the agency could avoid political influence and be funded similarly to other banking regulators. But Republicans have chafed at what they view as anti-business practices and a lack of oversight.

A common point of concern across jurisdictions around the world is how unscrupulous actors will look to harvest and hoard consumer financial data as it increases in scale. Large incumbents will find their customers to be less “sticky” and easier to “poach.” They’ll also find it harder to impose junk fees and harvest personal financial data for their exclusive use. The provisions provide for personal financial data rights for Americans, but would only have teeth after the CFPB defined the specifics through rules.
